The small-appliance definition and the recovery levels required.
The question
A factory-sealed appliance holds exactly 5.0 pounds of refrigerant. Is it a small appliance?
- No, because it must hold less than 5 pounds
- Yes, because the limit is 5 pounds or lessCorrect answer
- No, because it must hold less than 2 pounds
- Only if it is a household refrigerator
Why “Yes, because the limit is 5 pounds or less” is correct
The definition in 82.152 reads "five (5) pounds or less of refrigerant." An appliance at exactly 5 pounds that was factory-made, charged and sealed is a small appliance.
Source: 40 CFR 82.152
Why the other answers are wrong
- No, because it must hold less than 5 pounds — The definition says five pounds or less, so 5.0 pounds is included.
- No, because it must hold less than 2 pounds — Two pounds is the container size in the small-can sales provision for MVAC refrigerant, not part of this definition.
- Only if it is a household refrigerator — The definition lists many kinds of appliances, not just household units.
