What must the landfill obtain?
Recovery requirements · EPA 608 Type I. The correct answer, and the reasoning behind it.
The small-appliance definition and the recovery levels required.
The question
A household refrigerator arrives at a landfill with no refrigerant left because it leaked out during years of use. What must the landfill obtain?
- Nothing, since there is no refrigerant to recover
- A nitrogen test charge proving the system holds no refrigerant at all
- A report to EPA within 30 days of delivery
- A signed statement that the refrigerant leaked out before deliveryCorrect answer
Why “A signed statement that the refrigerant leaked out before delivery” is correct
Under 82.155(b)(2)(iii), if all the refrigerant has leaked out, the final processor must get a signed statement saying so and that recovery is not possible. The statement is kept with the other disposal records.

Why the other answers are wrong
- Nothing, since there is no refrigerant to recover — The rule still requires paperwork when all the refrigerant has leaked out.
- A nitrogen test charge proving the system holds no refrigerant at all — No test charge is called for; the requirement is a signed statement.
- A report to EPA within 30 days of delivery — There is no reporting deadline to EPA for this; the statement is kept on file.
